TDS benefit should be given even if deductor failed to upload correct details in Form 26A
As per the Court, TDS Benefit should be given to the deductee, even if the deductor has failed to upheld the correct details in form 26-A. The benefit should be given to the assesssee on the basis of evidence produced before the Department.
This Judgement was originally made by Bombay High Court. Same is now affirmed by the Supreme Court as well.
