Chartered Accountants will not pay the cost of dilemma

In a very recent case, revenue department has lodged a FIR against a Chartered Accountant in Punjab. Few kms away in state of Haryana, one of the CA executive was alleged to have been involved in harassment when he refused to give NOC without fees settlement. There has always been a stir between a CA and his clients on his fees, between a CA and revenue department for vested responsibility and between CAs and society for the high quality and modest personality they carry. Why is that it is always the CAs who have to compromise? Why does client doesn’t pay the fees until he really feels the heat, why is department presume CAs to be hand in gloves with their client when taxpayers do malpractices, why is society always ready to degrade the profession on getting a chance. From Prime Minister to a peon in a tax department believes CAs to have money running in and out of their homes, pockets, office and god knows from else where these people think off. But one thing is certain, in this war of conflict, it is always the alphabet of trust which are let down. That is exactly what happened in Ludhiana recently. Time is not far when most of CAs would be under the radar for their alleged involvement in tax evasion.

It must be understood that CA is one of those profession which is regulated by an Act, enacted much before constitution of India. Be it central excise, income tax, service tax or any law for that matter, it is the CAs who had always remained at forefront to help the government. There had been huge ups and downs which Indian Economy has seen, it was the valuable suggestions and support of CA fraternity that pulled out the economy from slipping down to rock bottom. But why is that in the conflict of dilemma, the second party is ready to mud the Chartered Accountant and come out clean. It must be remembered that CAs are their authorized representative who come forward to contest the legal matters. It by no way means that he is aware and is part of the illegal acts his client might have carried out. Neither he is suppose to act as an investigating officer nor he should be expected to know in and outs of the client. The boundaries have to well defined. The department is often found blaming chartered Accountants for low tax collections or being jealous of their knowledge which they use to help their clients. Yes we do possess extraordinary knowledge to find loopholes for clients, which we call tax planning and not tax evasion. And let me categorically mention here, that as a fraternity we hold enough strength and courage to shatter the Indian economy within seconds. We are the foundations and not the epitomes which if destructed with let the building fall down in no time. Also let me find the courage to say that we also know things which are very dear to these revenue officials which if disclosed in open might have catastrophic effect.

So as they say, good things are goods when handled diligently. But once they become destructive, they becomes difficult to handle. That’s what CAs are. We assure the department of our full co-operation in plugging the tax leakages along with educating taxpayers, doing efforts along with the government but that does not mean that we have lost all respects and dignity. We had and will always stand by the department, but certainly will not pay the cost of dilemma.
