CA Exams: SC directs ICAI to publish a press release for addressing concerns of students

SC on plea for conduction of CA Exams with Precautions

Supreme Court has directed ICAI, to notify on the website, the concerns of students, and steps taken by the Institute to redress them. This should be done so that students are aware of the corrective measures.

Court has directed ICAI to release a press note to inform the candidates of the measures taken by it with respect to the conduct of the exam in accordance with COVID-19 Guidelines.

The Writ Petition was disposed of, with a note that ICAI should release SOP for the same.

The main concern was that some exam centres are in containment zones. Four centers apparently fell in containment zones. Also, CA exams cannot be via online mode. This is because the exam format is different and cannot be done in that manner.

The CA examination is scheduled to be held between November 21, 2020, and December 14, 2020.

The Petitioners have alleged that the ICAI proposes to conduct the examination in absolute violation of the Central Government guidelines which prescribes a cap for candidates per exam hall.

The Petitioners have pointed out that this time, the number of candidates appearing for the CA examination will be significantly higher. This is because the May 2020 round of exam was cancelled. The same has now been merged with the exams due in November.

Thus, it has been urged by the Petitioners that any infraction in the safety and security standards. This would invariably lead to material infringement of Fundamental Rights of the candidates.

ICAI said that they are strictly acting in compliance of MHA guidelines. They will not put to risk the students. However, they cannot provide isolation rooms and risk with COVID patients coming in and putting others at risk.
