CA granted bail in PMLA case after his wife suffers serious injuries

Madan Gopal Chaturvedi, a chartered accountant, was granted interim bail of 10 days by the special PMLA court to care for his wife, who suffered severe injuries after a fall in the bathroom, and their minor children, who were left alone in the aftermath of the accident. The court stated that it must take a humane approach, and that the families of economic offenders are completely unaware of their breadwinners’ actions.

“One fine morning, such a person is arrested, and the family members have no idea what has happened, or what crime their father or breadwinner has committed.” “Children of such accused, raised in a moderately good environment, must face far-reaching consequences for their father’s actions,” special judge MG Deshpande said.

Chaturvedi was arrested in January of this year in connection with a money laundering case involving Yes Bank promoter Rana Kapoor and HDIL promoter Rakesh Kumar Wadhawan.
The reprieve was in effect from Monday to December 15. The court ordered Chaturvedi to surrender by 4.30 p.m. on December 15, or face serious consequences. The court also stated that Chaturvedi’s plea was being heard for the first and only time. It went on to say that the ED was free to delegate their staff for round-the-clock vigilance, but that the costs would have to be borne by Chaturvedi. He was also told to hand in his passport.

The court noted in its order that the accused’s family had no one to look after their mother except two minor children. It was based on medical documents provided by a “well-known orthopaedic surgeon.” The court stated that, in the absence of a history of issuing forged medical certificates to the accused, the doctor’s opinion could not be dismissed.

“As a result, the impact on the children and their father’s genuine need to cope with the same is an ardent need that is reflected in the application and medical papers.” As a result, I believe that the application deserves to be granted solely on humane grounds,” the court stated.
